lots of damage, totaled?

hello, I drive a 2016 Toyota Rav4 with 35k miles on it. I was rear-ended about 2 weeks ago, and my car has been at the auto body shop since then. The KBB value of my car prior to the accident was about $15,000, and the estimated cost to fix was just over $9,000. i was shocked when my car wasn't totaled. I have been in communication with the shop and they told me they found extra damages past the original estimate, and it sounds like they are having a difficult time. The shop told me the they were basically rebuilding the back half of my car from the inside out. I got of the phone with them today, and it's going to be in the shop another week. At a certain point, if the car has been in the shop for a long time and the are having a hard time fixing it, can I ask my insurance to total my car. the cost of everything including labor has to cost more than the car is worth. There has also got to be a fee for keeping the car on their lot, and insurance is also paying for my rental car. I would appreciate any advice. thank you

No, you cannot. The insurance company has sole discretion in whether it is totalled or not. Thank you for your reply. I know a total loss is in the hand of the insurance, but I guess my real questions is: What would happen if the cost of repairs reaches the total loss threshold while the car is in the middle of repairs?

That is their problem. They could reverse course if no repairs had been already made but if they have they will likely follow through to the end. Addons to repair estimates happen all the time. It's quite common. Don't forget the "unseen" value damage is owed to YOU also. This car fixed is not worth what it was before as it's marked all fixed up not an clean un-hit car - it was totaled IMO they just screwed up and aren't going to quit now get the best job you can PLUS that loss of value! T

There is no such thing as "loss of value" with an insurance repair. They repair the car and give it back to you. That's it. I don't want to find out today's laws on them but try trading in a car or vehicle that's marked as having that much damage and see what they offer you? If not listed as a "Major collision repair" like it's turning out to be it was hacked. That's listed try to sell one book value just went in the dump, T

I don't disagree the value is reduced. They have here AND was an insane fight with the buzzards. This was REAR ended suggest ANOTHER's fault owes the total of REAL damages monetarily for the incident. Plenty of IDK about it. MA (one lone state for this) might be the reason? If collecting on your own insurance now they'll dig out the disclaimer nothing is insured ever no matter what crap we just want your money :-) it's true unfortunately. Off that. Say you were buying this one and beside it same identical thing without this mess which would you choose? People do find out insurance really does another hit it won't pay the full total value of one un-wrecked like this and WIN! Stinks, T
