dui or wui. you tell me

any body ever heard of getting there drivers liecence pulled for a dui that didn't involve driving of any sort. i got arrested when i was 19 for drinking. i was walking and they gave me a dui. that don't make sense but there was nothing i could do about it cuz they told me if i didn't stop auguing with them that i was going to be spending alot more time with them. cops have too much power now days. and thats a bad thing. we need a law that says if your under 30 you cant be a cop. too many young trigger happy cops out there. thats how people keep getting killed. my brother in law got beat by a cop that had him in hand cuffs. which should be illegal. this cop didn't look anyolder then maybe 22. maybe.

Seems to me that the people that have a problem with police re the people that have had a problem with police. If there were no young police, there would not be the experience needed in the later years they're on the force. I have had many run ins with the police in my lifetime and have nothing but respect for them. Usually if there is a bad story on one, such as you mentioned, there is usually other things you do not know. So I feel they have a job to do and they are usually with the lower end of society and they get kind of callus to anyone that gives any crap to them. So no sympathies from me. Good point of discussion though. Being way2old is why I need help from younger minds

Dui is clearly illegal. Walking while intoxicated is legal but if you are a nusance that's not!! I REALLY THINK WE SHOULD RESPECT THE POLICE THAT WE PAY FOR THRU TAX DOLLARS TO MAKE US ALL SAFE!! Do each and every one of them make the right choices. Of course not. We have a system to dispute it. I simply have to repect the police who really are looking out for the public good. If anyone can dream up a better system please post it. For now -- where I live it's a good system. I've know several COPs (Citizens of Police) and I hated getting a traffic ticket now long ago, but these folks are scared to death to even pull over a car or go into harms way and sometimes get hurt or killed doing it!! They have my support, T

well let me back up the story alittle. me and my friend where trying to help a girl we know get away from a small party cuz her boyfriend was trying to beat her. so being good friends we started to walk her home seeing neither one of us had a car at the time. when we got across the bridge they where sitting there and busted us there. they never asked me anything cuz i'm deaf and i had made that a point when they first walked up to us. they just put hand cuffs on me and put me in the car. no questions asked. i don't mind cops it's the "bad" cops i'm worried about. seeing they knew i was deaf they got away with alot of things such as telling me to sign a paper cuz it was the only way i was getting out. while i was alittles drunk. i had 5 beers that night. turned out that paper was a waiver to go to court. so i signed my right to go to court and didn't know it. that part was my fault but why do someting like that to a deaf guy. and somebody who was trying to help somebody else. that aint right.

Darrin, If you can picture this............ My right hand with thumb up and index finger pointed out and then like a fist with just little finger extended should spell out "Hi" in sign!! Peace friend. I had a run in with cops that didn't make my day in around 1985 in Maine. Two rookies did arrest me for OUI and were such fumbling fools they didn't even know how to work the handcuffs they were issued and brought me in and I quickly tested NOT DRUNK and they were pissed. They were wrong and I needed a lawyer to clear it up which was done. The cops issued my a speeding ticket (I was speeding but not that much) for some outrageous speed and that's what I fought. Still cost me a lot of money and I consider the whole thing wrongdoing by our police forces. The system worked for me even though a hassle. Sorry for your bad experience and yes BAD COPS do exist but for the most part I think they work for the common good. Smile friend and just know that no good deed come without proper punishment, T

The drinking laws have become very strict in the past years. If you are under the influence and moving it seems that, that is enough to get a DUI.

In my experience the vast majority of police are decent people(at least in Canada) ..but all it takes is one run-in with a yahoo cop on a power trip to ruin your opinion of them. As far as getting a DUI for walking? That's total BS!! ..you should have fought that in court.. in a lot of area's you can get arrested for public intoxication, but NOT DUI if you're not operating a motor vehicle. Also, as painful as it can be it's usually best to treat even a jerk-cop with respect... It's tempting to tell the guy where to go when he's being an A-hole, but always keep in mind that he can make your life very uncomfortable, and if he lays bogus charges against you that are totally unfounded, guess who the judge is more likely to believe: You, or a police officer? ;) In short, just answer the questions 'yes, officer' or 'no, officer', and take out your frustrations later on a punching bag or something.

The police aren't really that different from anybody else, theres good and bad, but I have the most respect these men and women that put their lives on the line every day, nobody is perfect.Just thank GOD you're in the USA or Canada

well, now..a friend of mine (a mentally challenged guy) once got a DUI for driving his riding lawn mower along the sidewalk while drunk. spent 48 hrs in jail for it. after it was all over it had cost him (his mother) over $5000.00 in lawyers fees, court costs, and fines. He told me a couple of years later: "rick, i dun lernt a big lesson. i know whuts wrong and don't do it no more. and when i see a officer i go the udder way." Well, i tickled me just a bit. but when i thought it out i realized he was right and had good advice. I follow it religiously to this day!

The police tried to give me an OWI (operating while intoxicated) While I was driving my golf cart (on our way to the bar). My buddie insisted on Telling the cop that he would tell his mommy if the cops gave me a owie(OWI) Thecop laughed so hard he let us go

While it may feel great to yell at a cop who is on a powertrip and clearly is making a bogus charge on you, it will do no good whatsoever. What you do is refuse to make any statements of any kind, written or verbal. When the red and blue lights are on you're not doing yourself a favor by opening your mouth. The courtroom is the place for this be settled. You had witnesses, and believe it or not the police are witnesses for you as well in this case! In order to convict someone of an OWI, there are multiple criteria of the offense and all of them must be proven beyond a reasonable doubt to convict you. The criteria are as follows; 1. you were in operation of a motor vehicle on PUBLIC roadways. If you have a 40 acre field in the boonies you can be as hammered behind the wheel in it that you want, tho for safety reasons its not a good plan. 2. you had a blood alcohol level at or above the legal limit for intoxicated driving in your state (I think all of them are .08 now). You're probably wondering why I said the cops are your witnesses too. Well they have to testify if you take this to trial (and you should). He will have to say what make of vehicle, license number, etc. he pulled you over in. Since you were on foot, he can't. If he tries, subpoena his dash camera footage from his squad car. If you were driving a car it would've recorded the traffic stop. Since there wasn't one, you get the opportunity to show the entire court what an idiot he is. After you are acquitted, file a formal complaint with the police department on the officer involved showing exactly how your rights were violated and it will stay on his file for some time for it if he still has a job. Maybe he'll end up as a meter maid. Most cops don't try to pull this crap, but there is no reason why it shouldn't be dealt with as long as all details of your account are accurate. You and your witnesses were drunk and have no credibility to a jury, but the cop himself is a credible witness to them. All you have to do is prove him a liar with the very tools that he has provided to get justice served. Best of luck to you.

Probly not Tom, think it will be ongoing- forever. My cuz got a dui, cuffed & stuffed, an the horse he was riden went home! True story! Dirt road! B F Arkansas!
